Terms of Sale
1. General Notice
The purchase of wine, particularly collectible and older vintages, is subject to inherent risks. While we strive to provide the most accurate information and the highest standards of care, we do not guarantee the condition or drinkability of any wine, especially those with significant age.
2. Authenticity and Provenance
We make every reasonable effort to ensure the authenticity and proper provenance of each bottle offered for sale. This includes sourcing from reputable suppliers, documentation reviews, expert assessments, and storage in optimal conditions. However, due to the nature of the secondary market and the limitations in verifying historical chains of custody, absolute guarantees cannot be provided.
3. Bottle Condition
Photographs and condition notes are provided for reference purposes only. All wines are sold as is, and bottle condition may vary, including but not limited to: label damage, capsule imperfections, signs of seepage, low ullage, or other signs of age. These do not constitute grounds for return or refund unless explicitly stated otherwise.
4. Storage and Transport
All wines are stored in climate-controlled environments. We offer shipping options through specialized carriers where possible; however, once a shipment has left our facilities, we are not responsible for any damages, temperature-related issues, or delays that may occur during transit.
5. Drinkability and Taste
We cannot guarantee the organoleptic quality (taste, aroma, texture) or drinkability of older wines. Bottles may have evolved in unexpected ways over time. By purchasing aged wines, you acknowledge this risk and agree that returns or refunds will not be accepted based on taste, cork condition, or other subjective assessments.
6. Cork Integrity
Natural cork degrades over time. Older vintages may experience cork failure or crumbling, even under ideal storage. The potential need for special opening techniques (e.g., Durand corkscrews) or decanting should be anticipated. Cork issues do not qualify for returns or exchanges.
7. Pricing and Availability
Prices are subject to change without notice. All sales are subject to availability at the time of order confirmation. We reserve the right to cancel any order due to inventory errors, mispricing, or other system issues.
8. Returns and Refunds
All sales are final. We do not accept returns or offer refunds for any wines, unless a product has been shipped in error. Due to the nature of collectible wine and the risk of bottle tampering, no claims will be accepted once the bottle seal has been broken or the wine has been opened.
9. Legal Compliance
By placing an order, you confirm that you are of legal drinking age in your country or region. You also agree to comply with all applicable laws and regulations regarding the purchase, importation, and possession of alcoholic beverages.
10. Limitation of Liability
In no event shall the seller, its owners, employees, agents, or affiliates be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, any product purchased from this website. Our liability shall be strictly limited to the amount paid for the item in question.
11. Jurisdiction
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the seller is based. Any disputes arising from a sale shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
12. Additional Notes on Collectible Wines
Wine is a living product. Even when perfectly stored, bottle variation can occur. The same wine from the same case may age differently. By purchasing from our platform, you accept that collectible wines come with inherent uncertainties, and your expectations should reflect the uniqueness of each bottle.
Terms of Payment
1. Accepted Payment Methods
We accept the following payment methods:
- Credit cards (Visa, Mastercard, American Express) via Stripe
- Bank transfers (details provided at checkout)
2. Payment Policy
All orders must be paid in full prior to shipment. Orders are not considered confirmed until payment has been received and cleared.
For orders paid by bank transfer, payment must be received within 5 business days of order confirmation. If payment is not received within this time, the order may be canceled without notice.
3. Currency
All prices and payments are in EUR / USD / HKD, unless otherwise stated. Any currency conversion costs or international banking fees are the responsibility of the buyer.
4. Security
All credit card payments are processed through a secure third-party platform. We do not store your payment details on our servers. All transactions are encrypted using SSL (Secure Socket Layer) technology.
5. Taxes and Duties
Prices listed do not include any applicable taxes, customs duties, or import fees. These are the sole responsibility of the buyer and may vary depending on the destination country.
6. Retention of Title
All goods remain the property of Rotamagus Wines Ltd. until full payment has been received. We reserve the right to withhold delivery until all amounts due have been paid in full.
7. Late or Failed Payments
In case of failed or delayed payments, we reserve the right to cancel the order and relist the product. No wines will be held or shipped unless payment is confirmed.
8. Invoices
Invoices will be issued upon payment and will reflect the final confirmed price of the goods purchased, including any agreed shipping costs.
